Anson County:
*** ** - Abraham Bellew - From the "Family Tree Book" by Thomas Smith,
         apparently based on some work of his ancestor, William Smith.
         Abraham Bellew (c1746 - ), son of Isaac Bellew settled in Anson
         Co., NC, and married Catherine (Katie) Smith, daughter of Phillip
         Smith.  They had a daughter, Mary, born c1775 who married John
         Smith (III).  We do not know when he came to America but from
         the records we are assured he was a substantial citizen and a man
         of substance, owning select tracts of rich bottom lands of Flat
         Fork Cr, Cedar Cr, Brown Cr., Fork of Brown Cr, etc.  He was an
         accomplished gentleman of education and refinement.  His brother
         ----Bellyew was a surveyor after the type of Geo. Washington, we
         now term them engineers.  He lived in the section of the county
         now known as Horne's School House not far from the PeeDee River,
         was a large owner of choice tracts of land and owned many slaves.
         He was a substantial citizen of influence and standing, as he is
         numbered with Wm. Baiford, Samuel Flake, John Smith, John
         Williams, Joseph Allen and other REGULATORS [Note:  Abraham was
         said to have been found dead with a Regulator card in his pocket
         as appears on the Colonial Records of the Province of NC. Abraham
         was captured in 1771, at the Battle of Alamance.  To prevent being
         hanged and quartered, Abraham took the oath to the British Crown
         and  afterward "conscientiously abided by the oath." When the
         Revolution came we find Abraham Bellyew an active, partisan
         Loyalist and Captain in the British Army, commissioned by Lord
         Cornwallis. He was killed in battle.

         was originally granted to Sarah McPike 25 April 1767 and later

Mar 18 - 18 March 1775 Henry Belyeu bought 150a on the southwest side of
         the Pee Dee River on the upper side of Cedar Creek, adjacent James
         Hutchin, from Aaron Tallant and Sarah his wife for L80. The land
         was granted to Charles Smith 16 December 1769 and sold by Smith to
         Aaron Tallant. Witnesses: Abraham Belyeu [signed], Moses [X]

Apr 06 - 6 April 1776 Abraham Belyue, Jr bought 200a from Thomas Wright and
         Martha, his wife, for L20 proclamation money.  The land was
         originally patented by Thomas Wright 25 July 1774 and was on the
         southwest side of the Pee Dee River on both sides of long branch
         of Cedar Creek, adjoining said Abraham Belyue's land, Isaac
         Belyeu, Moses White.  Witnesses: Shadrach Denson, William [X]
         White. Thomas and Martha Wright made marks.  Recorded January

         originally granted to James Oliver 23 July 1774 and was on Cedar

Sep 12 - "Gen. H.W. Harrington to Major General Gates: Camp near Cross
         Creek, 12 Sept 1780. Sir; Yesterday evening just after I had the
         honor to receive your favor by express I received a letter from
         Colo. Kobb, dated the 10th instant, wherein he informed me that he
         had been the day before in Anson County, as high up as within 12
         miles to Anson court house, that there was not the least
         appearance of British forces there, nor anywhere as he could learn
         on this side of Cambden. McLean, the deserter's story, I am now
         convinced was a fiction. The Colonel writes that a young man, late
         a prisoner, who left Cambden last Thursday, says the enemy have
         been shelling their horses, and have certainly sent some artillery
         to the southwest side of the Wateree River. Colonel Kobb has again
         defeated the Tories in a skirmish in Anson County. In the first he
         killed Captains John Douglass & ABRAHAM BELLEW (in the pocket of
         this last was found a commis. from Lord Cornwallis, of which the

         the Pee Dee River, beginning at a rock in the Branch that runs
         through the plantation...third line of Frederick Bass, Sr's 242a

         Nancy Bass [wife], for L135. The land was part of a 242a grant to

                  In this area, on both sides of the Catawba River, in both present
                  Burke and Caldwell Counties, are Lovelady Townships. However,
         given Lewis Lowman as overseer, and the Burn's old place listing,
         the road would have to have been near Connelly Springs, on the
         Burke County (south) side of the Catawba River.11*

         This indenture made and entered into, this the 14th day of
         September, one thousand eight hundred and sixty eight, between
         I.[sic] D. K. Ballew and Rosanna Ballew, and Mahala Johnson and D.
         M. Johnson, of the State of North Carolina and county of Cherokee,
         and Elizabeth Mosely and T. B. Mosely of the State of Tennessee
         and county of Polk, parties of the first part; Witnesseth that the
         said S. D. K. Ballew, Rosanna Ballew, Mahala Johnson, D. M.
         Johnson, Elizabeth E. Mosely, hath this day bargained and sold
         unto J. R. Hyatt, a certain parcel of land, for the sum of three
         hundred dollars, the receipt is hereby acknowledged, We, S. D. K.
         Ballew, Rosanna Ballew and Mahala Johnson and D. M. Johnson, and
         Elizabeth C.[sic] Mosely and T. B. Mosely, hath this day sold unto
         J. R. Hyatt, his heirs and assigns three eleventh parts of tract
         No. 602, containing one hundred acres, more or less, and also
         three eleventh parts of tract No. 138, containing one hundred and
         seventy acres, more or less, it being the land purchased by John
         Ballew, Deceased, of L. M. Denth (Doutheret), and said lands were
         taken up from the State, the one hundred acres lot by Alfred
         Weaver, and the one hundred and seventy one acre lot by David
         Thompson, deceased; and said lands bounded as follows, on the
         east side by J. B. Fain lands; and also on the north side by Fain
         lands, and on the west by Thomas Carter's land, and the south side
         by T. B. Mosely's land; it being on the waters of Wolf Creek and
         in the 4th district; We, the said S. D. K. Ballew, Rosanna Ballew,
         Mahala Johnson and D. M. Johnson, Elizabeth C.[sic] Mosely and T.
         B. Mosely, bind ourselves, our heirs and assigns forever against
         ourselves and against the claims of all other persons unto the
         said J. R. Hyatt, his heirs and assigns forever in fee simple, to
         make good and sufficient title to the above mentioned land with
         the waters and all mines and minerals therein contained; and we
         forever warrant and ever defend the above mentioned against
         ourselves, our heirs and assigns and against the claims of all
         other persons. In testimony whereof we have hereunto set our hand

         Rosanna Ballew, wife of S. D. K. Ballew, Mahala Johnson, wife of
         D. M. Johnson and E. E. Mosely, wife of T. B. Mosely, being by me
         privately examined, separate and apart from their husbands,
         touching their free consent in the said deed of conveyance; they
         on such their examination declared that they had executed the
         same freely, and of their own will and accord, and without any
         force, fear or undue influence of their said husbands or any other
         person, and did still voluntarily assent thereto, therefore let

         Mecklenburg County, NC:
         In the name of God, amen.  I Stephen Billue being of a sound
         disposing  mind but frail in body and aware of the uncertainty of
         the time when I may be called hence, do make this my last will and
         testament in the words following:
         First, I resign my body to the dust and my spirit to God who give
         it and will my funeral expenses, and all lawful debts be paid as
         soon after my internment as possible.
         Second, I bequeath unto my lawful and beloved wife, Mary Billue
         the whole of my property real and personal. Houses, land,
         tenements, furniture, household and kitchen, farming utensils,
         cattle, hogs, horses, sheep and everything else that may belong to
         me at my decease for her benefit and use to be disposed of as she
         may desire or her necessities require during her life time.
         Thirdly, after her decease, I bequeath the land to my son James R.
         Billue and the rest of the property that remains between Elizabeth
         Richmond, James Richmond, Agnes Owens, Stephen and Jane Wilson.

Land Grant Process by Betsy Pittman, a Burke County, NC Genealogist who did some research for Jim Hamlin (11).
The process of acquiring title to previously unowned land was a four-step process, resulting in the issuance of a grant/patent.  The steps were:
1) Entry - the prospective land owner went to the county entry-taker and
   described, for the entry-taker to write into his book, the acreage and
   location of the desired land, including neighbors, watercourses, roads
   and any other significant geographical feature (these are what are
   abstracted in Huggins' Volume I of Burke County Land Records);
2) Warrant - the entry-taker issued a warrant for survey to the county
   surveyor;
3) Survey - the county surveyor, or one of his deputies, went to the land
   and, with the help of young men of the family or neighboring families
   to carry the survey chains, surveyed the land;
4) Grant - if all the paperwork was in order, all fees paid, and there were
   no caveats to the land, the grant was issued.
This process often took several years. This process could break down at any
point along the way.

On the copies of the Burke County Ballew land grants, in each case, the first page shows the survey and plat of the land, plus the shuck (envelope) in which the grant was placed in the office of the Secretary of State (in) Raleigh. The second page is the warrant for survey (second step in the process.

The entry did not always become a grant. Thus, it is erroneous to say that the men "purchased" a tract; they merely entered it on the dates given in Huggins. In fact, in both of Joseph Ballew's grants, the acreage acquired was less than the acreage entered. This is because when the survey was made, there was not adequate vacant land to meet the entered acreage, so Joseph had to make do with less land. 11
