Mar 22 - James Sweeny
of Casey County vs
Elijah Stapp and Shadrach
Phelps
Filed 22 March 1823,
box 6--Sweeney purchased from Stapp a tract
of 100 acres on the waters of Greasy Creek in Adair in 1819. The
land was part of the estate of John Stapp, deceased. Elijah Stapp
made a bond and promised to make Sweeny a deed. Sweeny placed the
bond with Isaac Sno[d]grass for safekeeping and Isaac had since
died. Sweeny believed the bond was then passed on to Robert Powell
who delivered it to Caleb H. Ricketts. Sweeny believed Ricketts
then gave it to Stapp. Sweeny wanted a deed.
John Stapp's heirs, some
of whom were infants and some of whom
were in Missouri
were as follows: Benjamin Stapp, HIRAM BALLEW and
wife Dorcus, Shadrach
Phelps and wife Celia, John Lane and wife
Lucy, Micajah Triplett and wife Sarah, Lewis Triplett and wife
Patsey, Jeremiah Brager and wife Mary, Aseneth Stapp, Caty Stapp,
Patience Stapp. These heirs made a deed to Elijah Stapp for 100
acres, dated 19 May 1822, and all signed! The original 1819 title
bond to Sweeny listed the following as the heirs of John Stapp,
deceased: James, Benjamin
and John Stapp, Sarah Triplett, Celia
Phelps, Betsey Burton, Darkus BELLOW, Lucy Lane, Patsey Triplett,
Polly Stapp, Aseneth Stapp, Catherine Stapp and Patience Stapp.
