         John Ballew for and in consideration of the sum of two hundred and
         twenty dollars in hand paid at and before the sealing and
         delivery of them presents the receipt whereof is hereby
         acknowledged hath this day granted bargained sold and conveyed and
         do by these presents grant bargain sell and convey unto Thomas
         McT. Ballew his heirs and assigns all that tract or parcel of land
         situate lying and being in the Eighth district of the section
         known by lot no. one hundred and twenty two (122) containing one

         Fannin County
         Know all men by there presents that we Thomas M. T. Ballew
         principal Handsom Farmer security are held and firmly bound unto
         the Ordinary of said county and his successors in office in the
         just and full sum of one thousand dollars for the payment of which
         sum to the said ordinary and his successors we bind ourselves our
         heirs executors in the whole and for the whole sum jointly and
         severally formally by these present. Sealed with our seals and
         dated 7th day of February 1860.
         The condition of the above obligation is such that if the above
         bound Thomas M.T. Ballew Administrator of the goods, chattles, and
         credits of John Ballew, deceased late of Cherokee County, North
         Carolina, do make a true and perfect inventory of all and singular
         the goods, chattles, and credits of the said deceased which have
         or shall come into the hands possession or knowledge of the said
         Thomas M.T. Ballew or into the hands or possession of any other
         person or persons for him and the same so made do ? into the said
         court of Ordinary where he shall be there unto required and ?
         goods chattles and credits do well and truely administer according
         to law and true account of his actings and doings. Thereon when
         there unto required by the Superior court or Ordinary of said
         County and all the rest of the goods chattles and credits which
         shall be found upon the account of said administrator the same
         being first allowed by the Ordinary shall deliver and pay to the
         persons respectivly as are entitled to the same by law and if it
         shall hear after appear that any last will and testament was made
         by the said deceased and the same be proved before the Ordinary
         and the executors obtain a certificate of probate ? and ? Thomas
         M.T. Ballew do in such case if required tender and deliver up the
         said letter of administration then this obligation to be void
         else remain in full force.

         By the Ordinary of said county, John Ballew late of Cherokee
         County, North Carolina in which he died resident having lately
         departed this life intestate possessed of a considerable estate
         real and personal and Thomas M.T. Ballew of said county of Fannin
         having at a regular term of said court been vested with the
         administration on the estate of John Ballew on condition of his
         giving bond and security according to the direction of the Court
         and taking the oath of office and said Thomas M.T. Ballew having
         fully complied with the direction of the court. This is to show
         that said Thomas M.T. Ballew is fully empowered and required to do
         and perform all the duties of an administrator of John Ballew to
         administer according to law the estate of said John Ballew to ask
         demand and recover all of John Ballew claims to pay all his debts
         or obligations, so far as the estate will entend [extend?] so far
         as relate to the county of Fannin or State of Georgia and ? to pay
         out to the legal heirs and to make all proper return inventories
         appraisments and what ever other duties and estate administrator
         by law ? upon him witness, where of I have here unto set my hand
         and seal of office this 7th day of Feb. 1860.

May 17 - 1899 - Heirs of Thomas McTaggart Ballew to His Widow
         Georgia, Fannin County.
         Whereas Thos. McT. Ballew departed this life on the 17 day of May
         1899 intestate, although prior to his death, towit, on the 6 day
         of April 1899 he undertook to make a will which for want of a
         sufficient number of attesting witnesses and is incapable of being
         probated and void wherefore we the undersigned towit H.S. Ballew
         wife of the deceased and Olive L. Gilliam, Sarah E. Ballew, Thos.
         W. Ballew and John R. Ballew the children of said deceased
         desiring that the wishes of the said T. McT.Ballew as to the
         disposition of his property shall be fully and explicitly carried
         out make this several conveyance of all of the real and personal
         property estate and this several assignment of all of the debts of
         said estate so that the title of said real property and personal
         property shall vest and be the property of H. S. Ballew the wife
         of the deceased for and during her natural life as was attempted
         to be done by the provisions of said will and therefore this
         indenture made and entered into this the 12th day of July 1899
         between H.S. Ballew, Olive L. Gilliam, Sarah E. Ballew, T. W.
         Ballew and John R. Ballew, wife and children of said deceased for
         and in consideration of the affection we bear each other as well
         as a desire to carry out the last wishes of the deceased. First,
         Olive L. Gilliam, Sarah E. Ballew, Thos. W. Ballew and J. R.
         Ballew sells and conveys assigns and transfers to H. S. Ballew our
         beloved mother all the title to lots of land No.s 122 and 123 both
         in the 8th Dist. and 2nd Sect. of said county and containing 160
         acres each and also all of the personal property of every
         description belonging to said estate including horses, cows,
         cattle, livestock, farming implements, household and kitchen
         furniture, provisions, farm products, notes and accounts and all
         money on hand to be and remain the property of the said H. S.
         Ballew for and during her natural life with full and unconditional
         right and power to control and enjoy the same together the right
         and authority to sue and collect all the debts of all said estate.
         Second, H. S. Ballew, Thos. W. Ballew, Sarah E. Ballew and Olive
         L. Gilliam sells and conveys to John R. Ballew subject to the life
         estate of H. S. Ballew hereinbefore mentioned lot of land No. 122
         in the 8th Dist. 2nd Sect. of said county. Third, H. S. Ballew,
         John R. Ballew, Thos. W. Ballew sells and conveys unto Olive L.
         Gilliam and Sarah E. Ballew jointly lot of land No. 123 - 8 & 2
         subject to the life estate of H. S. Ballew as herinbefore
         mentioned. Fourth, H. S. Ballew, John R. Ballew, Sarah E. Ballew,
         and Olive L. Gilliam agrees and obligates themselves to pay Thos.
         W. Ballew out of any of the property of said estate the sum of two
         hundred dollars to be paid partly in property and partly in money
         as may be agreed upon by the parties to this instument two hundred
         dollars also to be subject to the life estate of the said H. S.
         Ballew as herein before mentioned. In testimony whereof the
         several parties to this instrument have hereunto set their hands
         and affixed their seals this the day and year above written.

         sum of Eight hundred dollars to him in hand paid at and before the
         sealing and delivery of these presents the receipt whereof is

         John Ballew his heirs and assigns, all that tract or parcel of

         Neil C. Berry for himself his heirs executors and administrators
         the said bargained premises unto the said John Ballew his heirs
         and assigns will warrant and forever defend the right and title
         thereof against themselves and against the claim of all other

Mar 30 - Signal & Advertiser The Atlanta Constitution of the 26th of this
         month says: We learn from parties who arrived here yesterday from
         Lawrenceville, that on Wednesday night, George Cates was mortally
         wounded by Jake Ballew, about four miles from Lawrenceville.

Jan 02 - Dahlonega Signal: We have just received the sad intelligence of
         the death of B.G. Thornton, of Birmingham, AL, which occured a
         few days ago.  He was once a citizen of this place.  He is the man
         who killed the desperado, John ballew, back in the fifties.
